Update: April 2010
The issue of the Maintenance charge was not discussed at the NAC Executive Meeting on the 20th April as this had to be postponed pending the General Election. We will have to wait to see if it makes the next meeting.

The meeting between the Council and Residents Association took place today at 2pm.
The meeting was attended by representatives of the Residents Association, Patrick Boyle from NAC, the 4 local ward councillors, Brian Donohoe MP and Irene Oldfather MSP.
No dicussion about the maintenance charge really took place. At the start of the meeting Patrick Boyle read out a statement from NAC, which basically stated that the Council are once again reviewing the charge – with a 3rd party, which at this time the Council will not disclose who this 3rd party is. When asked if the residents of Montgomerie Park could be involved this was rejected.
On the 19th of March 2010 another meeting will take place where the Council will present to the Residents Association their ‘proposed’ solution to the dispute.
This concluded the meeting.
So lets wait to see what NAC and this mysterious 3rd party propose and lets keep up the fight!!!

The Council have now replied to our letter and provisionally accepted the 5th of February 2010 for the date of the next meeting. The Residents Association will reply and accept this date.
Four representatives from Montgomerie Park will attend the meeting, which should be attended by Brian Donohoe MP and our four local ward councillors.
In the mean time, if you have time, please drop an email to your councillors and voice your concerns. I think the councillors are forgetting the level of anger around this issue and maybe need to be reminded that everyone is behind the Residents Association on this issue:

On 14th January the Resisdents Association were sent a letter in reply from NAC.
The new Cheif Executive has delegated that Mr. Patrick Boyle of NAC legal services continue dealing with this issue.
See his letter below, along with a reply from Elma Maurry (NAC Chief Exec):
Mr. Boyle agreed that another meeting should take place between NAC and the representatives of Montgomerie Park, however, he indicated that they did not want to cover issues previously covered (which of course have never been answered) and instead wanted to move forward and discuss some new topics.
Below is a copy of the letter which was sent to NAC in response to this today:-
Once again folks we need to stick together on this and refuse to pay until a suitable solution has been found.
Clearly NAC think we are simply going to roll over and pay for the high level of maintenance currently being carried out on the estate.
We will be once again contacting our local Councillors to inform them of this situation. What we need is for this to go in front of the full Council. So please if you have time contact your local Councillor and voice your concerns.
We will post more details once a meeting has been arranged.

The more work they do in the FIELD the more determined not to pay we become. They dumped six benches at a cost of £500 each (this information came from one of the installers) and have made a picnic park for the general public, which is fine as long as they don’t think we should pay for it. One bench is on the hill next to a dirty gravel path and another has a great view of a tree trunk. Another at the top of the field has a view of the by pass and the rest are handy for the walkers who frequent the path that has been there for at least twenty years without seating arrangements.. Who got the contract for supplying these benches and ofcource the new round table/seat round one of the new trees.As admin has always pointed out they want us to pay over our money but we have no say on how they spend it. I think we are not seeing the whole picture but we should be informed of anything they do as it could deter the sale of our houses.

I just wanted to thank the members of the Residents Association for taking time out of their busy lives yesterday to meet with North Ayrshire Council on our behalf. Hopefully there will be a positive outcome in March. If not, we will need to stick together and continue to fight this. Thanks again.

Couldn’t agree more with comment from EMS.
I think what sticks in my throat the most is the fact that many of these areas were maintained if only minimally, in the past by North Ayrshire council where they picked up the tab. Now very conveniently they decide to try and improve the area but force others to pick up the tab. The areas being maintained, the level of planting and replanting is ridiculous. I did ask NAC about the detail of planting and why it was felt necessary to carry out alot of it, especially in areas where it serves no benefit to the residents. They said residents were consulted as to what they would like to see in the area. Don’t no if this is true or not?
If we end up having to pay a maintenance charge we should just ask for grass cutting of main areas and get rid of the rest. The park area around the kids play park at Regalia view is so over the top and pointless. Can you imagine how much that is costing to weed on what seems like every other day . Also how mainy times are they going to try and plant trees on the main access road? They tell us we are not being charged for intial plantation. I have my doubts. We are probably paying for it through our council tax anyway. This being the same tax that residents of neighbouring areas pay and have their soft landscaping maintenace included.
In closing can i ask what our councillors response was when NAC basically appeared to dingy us yet again on the 5th?

The Council used a company in Glasgow to develop the ‘Masterplan’ which provides details about what planting should be done and give details about those useless paths that have been installed. This was all done long before the 1st house was built, so I fail to see how any residents were consulted? Unless they consulted people in Girdle Toll!
During the meeting on the 5th as it states above the Resisdents Association asked to be involved in this re-evaluation the council are now undertaking with this mysterious 3rd party. They rejected the proposal.
Maybe they are working with NATO or somehting as it is top secret and for a public body to keep secrets like this is just absolutely appauling.
As for the Councillors they were there more in body rather than soul. They had very little input, in fact as far as I have been told the only one who spoke was Councillor Barr who asked that letters be sent to all residents informing them that no action to recover any money would be taken until this new proposal has been presented to the residents.

Thank you admin. Yes i was just interested to hear what the reaction was from the councillors to NAC handling of our concerns. Just to make you aware. I sent an email to all involved. Not one has replied.
If you ask me 90% of all work completed is a waste of time. Further more, as the school and the neighbouring all weather pitches are delayed. The older kids have nowhere to play there ball games etc. We were all lettered to say the playpark at Regalia View should not be used for ball games and they tried to offer an alternative site. Dont know if you managed to get a look. It was so uneven it was dangerous. Not to mention the barbed wire fence that was its boundary one one side.
The Councillors need to get of their rear ends and do some work for us for once.
You really couldn’t make it up!

Where are the letters requested by Councillor Barr for NAC to alert residents to the fact that payment can be postponed until further notice. Again just to let you know, not one councillor responded to the emails i sent them prior to the last meeting!
